This Privacy Statement by Arthrex GmbH, Erwin-Hielscher-Strasse 9, 81249 Munich, Germany ("Arthrex” or “we"), describes the practices that Arthrex follows with respect to the collection, use, storage, and disclosure of your Personal Data in connection with our Synergy Integration Solutions Marketing Website ("Website") for information purposes.

While the majority of our customers are legal persons (i.e. organizations and companies), should you contact us in the capacity of an employee of a legal person, we will store and process the data presented below concerning this legal person, but will also connect this with the information that you are an employee and our point of contact for this legal person.

1. Scope of Application

This Privacy Notice (“Privacy Notice”) applies only to this Website. Our General Data Privacy Statement, located here, applies to the usage of our other internet services, receiving newsletters, collection of Personal Data during telephone calls or visits to our premises, and additional information as to how we process Personal Data from (potential) customers and business partners outside of this Website.

2. Data Collection While Using This Website

In this section, we describe how we process Personal Data concerning you that we collect in connection with this Website and other web services, and your rights regarding this.

2.1. Technical Information

When you visit our Website, our web server temporarily records the domain name or the IP address of the requesting computer as well as the date of access, the client file request (filename and URL), the HTTP response code, the website from which you visit us, the number of bytes transferred with the connection, and, if relevant, further technical information to use and evaluate statistically for the technical processing of Website use (e.g. for the delivery of content, guarantee of functionality and safety of the website, and defence against cyber attacks and other misuse).

Temporary storage of the above information for the duration of the session by the system is required to allow the Website to be displayed on your computer.

Some of this Personal Data is also stored in our system. This data is not saved together with the IP address or other Personal Data relating to you personally. However, the associated analysis services, processes, and stores Personal Data in compliance with the Usage Agreement as it relates to the technical processing of Website use (lawful basis: Art. 6(1) (b) GDPR) and, otherwise, safeguards our legitimate interest in making our Website as user-friendly, safe, and attractive as possible while boosting sales of our products and services (lawful basis: Art. 6(1) (f) GDPR).

2.2. Cookies

We use cookies to process Personal Data that we have collected. Cookies are files that are placed on your computer and accessed by our server when you visit our Website. We use cookies to ensure usage of the Website is more convenient.

In addition, analysis cookies allow for the compilation of usage and identification data by the original provider or third-party providers into pseudonymous usage profiles. We use analysis cookies to determine the number of individual visitors to a web page or service, to collect statistical data on the performance of our products, and to analyze the visitors’ usage patterns and visitor interactions on the basis of anonymous and pseudonymous information. This information cannot be traced back to a natural person. The legal basis for these cookies is Article 6 (1) a GDPR, and for third-party countries, Article 49 (1) a GDPR.

CLID

Identifies the first time Microsoft Clarity saw this user on any site using Clarity.

ANONCHK

Indicates whether MUID is transferred to ANID, a cookie used for advertising. Clarity does not use ANID and so this is always set to 0.

MUID

Identifies unique web browsers visiting Microsoft sites. These cookies are used for advertising, site analytics, and other operational purposes.

SM

Used in synchronizing the MUID across Microsoft domains.

You can prevent or restrict the saving of cookies on your hard drive by setting your browser to not accept cookies or deciding whether you agree before setting cookies. Cookies that have been set can be deleted at any time. Please refer to your browser operating instructions for additional details. If you do not accept cookies, this may restrict the use of our services.

Logfiles are deleted after no more than thirty (30) days. Most cookies expire at the end of the session or otherwise after no more than twenty-four (24) months (including the cookies used in the analysis services described in clause 3.2) and are then deleted. Extended storage occurs only after the information has been anonymized.

2.3. Use of Analysis Services

On this Website, we use Google Analytics as well as Microsoft Clarity. We use these analysis services for the purposes set out in this Privacy Statement and and also to safeguard our legitimate interests in making our Website as user-friendly, secure, and attractive as possible, and to promote the sales of our products and services (lawful basis: Art. 6(1) (f) GDPR).

2.3.1. Use of Google Analytics

Our Website uses Google Analytics, a web analysis service run by Google Ireland Limited, registered at Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). You can find more information on how Google uses data from your use of websites or apps from Google partners here: https://policies.google.com/privacy/partners?hl=de.

Google Analytics uses so-called "cookies", text files stored on your computer, that enable your use of the Website to be analysed. The information generated by the cookie about your use of this Website, such as pages visited, browser type / version, operating system used, referrer URL (i.e. last page visited), are typically transferred to a Google server and stored. It cannot be ruled out that such data processing may take place outside of the European Economic Area. For your safety, we have selected settings ensuring that the IP address will be shortened by Google beforehand within the area of Member States of the European Union or other parties to the Agreement on the European Economic Area. The full IP address is only transferred to a Google server in the USA and shortened there in exceptional cases. The data listed above can be used through identification, i.e. login to Google services. This way Google can determine that you are starting your visit to our Website on a PC and continuing it on a mobile device, and the data from both devices can be combined. We have not activated the user ID adjustment and thus do not capture this data.

Google will use this information on behalf of the operator of this Website for the purpose of evaluating how you use the Website, compiling reports on Website activities, and providing further services related to Website and internet usage to the Website operator. We have chosen settings to erase analytics data after 50 months in order to be able to compile and compare statistical data.

The IP address transferred by your browser within the scope of Google Analytics will not be associated with any other data held by Google.

2.3.2. Use of Microsoft Clarity

Microsoft Clarity is a user behavior analytics tool that helps us understand how users are interacting with our Website through features such as session replays and heatmaps. Microsoft Clarity captures the user interactions on the Website, such as how the page has rendered and what interactions the user had on the Website including mouse movements, clicks, scrolls, etc. The code to capture this information is open source and available on GitHub. By default, any sensitive content such as passwords, usernames, etc. are masked before being sent to Clarity. Microsoft Clarity is GDPR compliant as a data controller. 2.4. Processing With Regards to Usage of the Contact Form

Our Website contains a contact form that you can use to communicate with us. When submitting information through the contact form, you are required to enter an email address, which we will use for responding to your request. The contact form enables you to submit additional information on a voluntary basis. If you provide us with Personal Data via the user account or the contact form for a purpose beyond the use of the Website or respective web service, such as sending us an offer or product information, we will also store and process this data for this purpose.

4. Your Rights

You should be aware that you are entitled to request access to your Personal Data (and certain information on its processing), rectify incorrect and incomplete data, and/or in certain circumstances (Art. 15 through 18 GDPR), request the deletion or restriction of processing of your data. Where the processing is based on the interest of Arthrex in documenting your consent, you also have the right at any time to object to such processing (Art. 21 GDPR) on grounds relating to your particular situation. Finally, you should be aware that you also have the right to receive your data in a structured, commonly used, and machine-readable format under certain circumstances (Art. 20 GDPR).

You should be aware that you are entitled to submit a complaint with a supervisory authority. The supervisory authority with general personal jurisdiction over Arthrex is the Bayerisches Landesamt für Datenschutzaufsicht. We will not make any decisions without your consent that have a legal effect on you or considerably impact you in a similar way, and which are based exclusively on automated processing (including profiling).

We may amend our processes and this Privacy Notice in the future. We will notify you of any updated versions of this Privacy Notice by approptiate means.
